BREAKING NEWS: Illegal Immigrant Indicted in Child Rape Case

A 22-year-old Salvadoran illegal immigrant living in Wyandanch has been indicted on rape and sexual abuse charges involving a six-year-old child, Suffolk County District Attorney Raymond Tierney announced Tuesday.

Nixon Nehemias Marquezmestanza was indicted on two counts of first-degree rape, first-degree sexual abuse and endangering the welfare of a child.

According to prosecutors, Marquezmestanza had direct childcare access to the victim and allegedly sexually abused the child on several occasions during July and August 2026.

Following the last alleged incident in August, the child told family members about the abuse, and the family contacted police.

Marquezmestanza was arrested August 31st following an investigation by the Suffolk County Police Department’s Special Victims Section.

“This brave young victim told someone, and her family acted on it immediately. That is how these cases come to light,” Tierney said. “Protecting children is a core responsibility of this office, and we will see this case through.”

Marquezmestanza was arraigned September 15th before Acting Supreme Court Justice Karen M. Wilutis.

The two first-degree rape charges are Class B violent felonies, while first-degree sexual abuse is a Class D violent felony. Endangering the welfare of a child is a Class A misdemeanor.

Wilutis ordered Marquezmestanza held on $500,000 cash bail, $1.5 million bond or $5 million partially secured bond while the case is pending.

He is scheduled to return to court October 29th and faces up to 25 years in prison if convicted of the top charge. He is represented by attorney Ira Weissman.

U.S. Immigration and Customs Enforcement has lodged a detainer seeking custody of Marquezmestanza following the prosecution.

Assistant District Attorney Christina O’Dea of the Child Abuse and Domestic Violence Bureau is prosecuting the case.

Detective Glenys Gonzalez of the Suffolk County Police Department’s Special Victims Section conducted the investigation.
