Illegal Immigrant, Repeat DWI Offender Gets Up To 7 Years

A 36-year-old illegal immigrant with five drunken-driving convictions, including four felonies in the past decade, has been sentenced to up to seven years in state prison after Suffolk prosecutors said he repeatedly returned to the road while intoxicated.

Pablo Aguilar-Alvarez, a Salvadoran national, was sentenced Sept. 22 to 2⅓ to seven years following his August conviction for felony driving while intoxicated and other charges.

“Pablo Aguilar-Alavarez was convicted for driving while intoxicated five times yet continued to get behind the wheel drunk, placing innocent lives at risk,” Suffolk County District Attorney Raymond Tierney said.

Prosecutors said Aguilar-Alvarez drove to a Southampton gas station after drinking on Nov. 29, 2025. While inside, his girlfriend asked a clerk to call 911.

Police located the vehicle and allegedly saw Aguilar-Alvarez run a stop sign and cross the double-yellow line. After stopping, prosecutors said, he climbed out the passenger side in an attempt to conceal that he had been driving.

A breath test registered his blood alcohol content at .17%, more than twice New York's .08% legal threshold.

A jury convicted Aguilar-Alvarez Aug. 7 of two felony DWI counts and aggravated unlicensed operation.

Despite prosecutors requesting that he be remanded, the court released Aguilar-Alvarez pending sentencing and explicitly prohibited him from driving.

Ten days later, District Attorney’s Office investigators allegedly caught him driving without a valid license in Riverhead. Federal immigration authorities subsequently detained him after consulting with Suffolk prosecutors.

“His repeated disregard for the rule of law and the safety of others makes clear that he is a danger to our community,” Tierney said. “Today’s maximum sentence holds him accountable and removes a proven threat from our roads.”

Prosecutors said Aguilar-Alvarez was deported in March 2024 and is currently unlawfully present in the United States.

ICE has lodged a detainer and is expected to take custody of him after he completes his prison sentence.
